Notice Of Public Hearing
TAKE NOTICE that the Water Resources Division (WRD) of the Michigan Department of Environmental Quality (MDEQ) will hold a public hearing at the Paw Paw Township Hall, Main Meeting Room, 114 North Gremps Street, Paw Paw, Michigan on Tuesday, October 18, 2011, at 7:00 p.m.
The purpose of this hearing is to secure the views of interested persons concerning the following application for permit:
Application for permit 11-80-0046-P under part 301, Inland Lakes and Streams, of the Natural Resources and Environmental Protection Act, 1994, PA 451, as amended, by The Village of Paw Paw, Attn: John Small, P.O. Box 179, Paw Paw, Michigan. The applicant proposes to drawdown Maple and Ackley Lakes for the purpose of aquatic weed control. The lakes will be drawn down up to 4 vertical feet at a rate of 0.5 feet per day during the fall of 2011. Refilling will occur in late winter or early spring of 2012 at a rate of 0.5 feet per day. The project is located south of Power Plant Road and M-40 in T3S, R14W, Sections 1 and 12, Village of Paw Paw and Paw Paw Township and in T3S, R!#W, Sections 6 and 7, Antwerp Township, Van Buren County, Michigan.
The application is available for review at the MDEQ Web Site, http://www.deq.state.mi.us/CIWPIS, or may be reviewed at the MDEQ, WRD, Kalamazoo District Office, 7953 Adobe Road, Kalamazoo, Michigan 49009-5025, or by calling 269-567-3500. The public hearing record will remain open for ten days after the public hearing date. Any written comments to be submitted for the public hearing record must be received at this address on or before the close of the record.
The hearing will be held pursuant to Section 30105 of the cited statute. The hearing will not be a court-type proceeding; witnesses will not be sworn, and there will be no cross examination. Public hearings are primarily informational and are held to encourage the expression of views and presentation of facts.
The MDEQ will, upon written request, provide a copy of the MDEQ's decision on this application.
